1. Scope of Services:

a. Description of Services: Larisa Barbu Photography (referred to as “the Photographer”) agrees to provide professional photography services, as outlined in the contract or invoice, which will specify the scope, duration, and deliverables of the services.

b. Limitation of Results: While the Photographer will make every reasonable effort to capture high- quality images, the Client acknowledges that the outcome of the photography session may be affected by unforeseen circumstances, including but not limited to weather conditions, the behavior of subjects, or events beyond the Photographer’s control.

2. Booking and Payment:

a. Booking Fee: A non-refundable booking fee or deposit, as specified in the contract, is required to secure the photography services. This fee will be applied towards the total cost of the services.

b. Final Payment: Full payment for the services must be made, at least 3 days, prior to the day of the photography session, and/or as stipulated in the invoice issued by Larisa Barbu Photography.

c. Accepted Payment Methods: Larisa Barbu Photography accepts payment, as indicated in the invoice.

3. Cancellation and Rescheduling:

a. Client’s Cancellation: If the Client cancels a photography session with less than [10] days’ notice before the scheduled date, the booking fee or deposit is forfeited to compensate for the Photographer’s time and resources allocated for the session.

b. Photographer’s Right to Reschedule: Larisa Barbu Photography reserves the right to reschedule the session due to unforeseen circumstances such as illness, equipment failure, inclement weather, or other emergencies. In such cases, Larisa Barbu Photography will make reasonable efforts to accommodate the Client’s schedule for the rescheduled session.

4. Image Delivery and Usage:

a. Delivery Timeline: Larisa Barbu Photography will provide the Client with a number of edited, high- resolution images of the photography session and within the timeframe, as specified in the contract or invoice.

b. Usage Rights: The Client is granted non-exclusive, personal, and non-commercial usage rights for the images. The Client may use the images for personal purposes, including printing, sharing on social media, and displaying in a personal portfolio.

c. Photographer’s Copyright: We take pride in our work, and all photographic materials, including original negatives, photos, and slides, remain our exclusive property. Larisa Barbu Photography retains full copyright and ownership of all images, including the exclusive right to use them for promotional and portfolio purposes. The Client may not sell or otherwise distribute the images for commercial purposes without obtaining written consent from Larisa Barbu Photography.

5. Model Release:

a. In our digital age, we encourage you to share your photos on social media platforms, including Facebook and blogs. Please remember to cite our work. For the integrity of our craft, refrain from altering, cropping, changing colours, or editing our photographs, except for Facebook’s Timeline cropping.

b. Client’s Consent: The Client grants Larisa Barbu Photography the right to use the images for promotional and portfolio purposes. If the Client wishes to restrict or prohibit the use of their images for promotional purposes, they must notify Larisa Barbu Photography in writing before or on the day of the photography session.

6. Client Cooperation:

a. Client Responsibilities: The Client is responsible for providing accurate and necessary information to Larisa Barbu Photography before the photography session. The Client agrees to cooperate during the session to ensure the best possible results. This includes following the Photographer’s directions and guidance.

7. Editing and Retouching:

a. Editing Standards: Larisa Barbu Photography will perform standard editing and retouching on the images to enhance their quality. Additional editing or retouching requests may be accommodated at the discretion of Larisa Barbu Photography and may incur additional charges.

b. Our high-resolution images are crafted with care, ensuring a resolution of 300DPI with 3000 pixels on the longest edge.

8. Liability:

a. Property and Equipment: Larisa Barbu Photography is not liable for any damage or loss to property, equipment, or images during the photography session, whether it occurs due to the actions of the Client, guests, or external factors.

b. Unforeseen Circumstances: In the event of illness, accident, or other unforeseen circumstances preventing Larisa Barbu Photography from fulfilling their obligations, liability is limited to a refund of any payments made by the Client. Larisa Barbu Photography will make reasonable efforts to reschedule the session.

c. The safety of children and the protection of public or private properties during our sessions are your responsibility. We do not accept any liability in such cases.

d. For your convenience, we retain client files for up to 1 year after your photography session. Beyond this period, all files will be securely deleted.

9. Exclusive Photography Rights:

a. During our engagement, no other photographers, amateur or professional, are permitted to photograph at the venue, unless prior agreement with Larisa Barbu Photography. Breaching this agreement will result in non-completion of our services and forfeiture of your initial deposit.

10. Photographer’s Artistic Vision:

Our work is driven by our artistic vision and expertise. We welcome your special requests and encourage you to provide a “shot list” if you have specific preferences.

11. Photographer’s Break and Meal:

During extended sessions exceeding 5 hours, we kindly request a full guest meal.

12. Dispute Resolution:

a. Mediation or Arbitration: Any disputes arising from this agreement will be resolved through mediation or arbitration in accordance with the laws of United Kingdom.

13. Client Agreement:

a. Acknowledgment and Acceptance: By booking photography services with Larisa Barbu Photography, the Client acknowledges and agrees to these terms and conditions in their entirety.
